In short (not part of the terms)
- Beta features work but are new: check their figures against the source.
- Coming soon features are switched off: they do nothing and send nothing, and they are not part of what you pay for.
- The AI Assistant is Coming soon in this release; when we publish its model on our own download host (Cloudflare R2, under our account) it becomes a Beta Feature in every Plan. It runs on your own PC. Your questions, the figures it reads and its answers stay on that PC; we never receive them and no model is trained on them. Nothing of a conversation is kept after the panel is closed.
- The AI Assistant is an AI, not a person, and its answers can be wrong. They are not tax, accounting or legal advice. Check them against the reports.
- Don't use it for decisions about people (hiring, credit and similar), or with data a marketplace forbids you to use with AI.
LivingRoom Beta, Coming Soon and AI Assistant Terms Draft 2 of 2026-10-25 - not yet in effect
These terms are published by Point of the Mountain Software LLC, a Utah limited liability company ("Company", "we", "us", "our"), for its LivingRoom software ("Software"). They are part of the LivingRoom End User License Agreement ("EULA"). Words with capital letters have the meaning given in the EULA. If these terms and the EULA conflict about a Beta Feature, a Coming Soon Feature or the AI Assistant, these terms apply.
A. Beta Features
A1. What "Beta" means. A feature marked "Beta" in the Software ("Beta Feature") works and you may use it, but it is new: it has not yet been proven against enough real-world data or setups. Every Beta Feature carries the label where you use it. At the date of these terms, the Beta Features are:
- the imports of Amazon, eBay, Etsy and Shopify files and of advertising-spend files (Walmart Connect, Amazon Ads), until we have checked their format against real files from that source;
- the Generic 3PL (CSV folder) connection;
- Reports › Seller Performance › "From Walmart" (figures read from Walmart's seller performance service); and
- the AI Assistant (section C), once it is available.
A2. Check your figures. Before you rely on figures produced by a Beta Feature - especially imported sales, fees, costs and stock - compare them with the source (for example the marketplace's own reports or settlement statements). Tell us at [email protected] if they differ.
A3. No warranty; changes. Beta Features are provided "as is", without any warranty, and are excluded from the EULA's limited warranty. We may change, fix, limit or remove a Beta Feature, or remove its Beta label, in any Update. What a Beta Feature has already added to Customer Data (for example imported records) stays in Customer Data if the feature changes. If we remove a Beta Feature that is part of your Plan (Terms of Service section 3.1), such as a marketplace file import, without replacing it with a feature that does the same job, we will tell you by e-mail at least 30 days before the Update. During a paid Subscription period you may then cancel, and we will ask Paddle (Terms of Service section 2) to refund the unused part of that period; for a Lifetime License you may end it and receive the refund EULA section 16.5 describes (a License Key bought from a Reseller: EULA section 13.1). [to be confirmed]
A4. Feedback. If you send us feedback about a Beta Feature, we may use it to improve the Software without any obligation to you.
B. Coming Soon Features
B1. What "Coming soon" means. A feature marked "Coming soon" in the Software ("Coming Soon Feature") is built into the Software but switched off. It does nothing, and sends and receives no data, unless and until a later release of the Software (or a test under section B5) switches it on. At the date of these terms, the Coming Soon Features are:
- direct connections to the Amazon Selling Partner API, eBay, Etsy, Shopify and a custom marketplace API;
- signing in to Walmart through our connection service, creating Walmart Fulfillment Services inbound shipments, and the Walmart Canada and Walmart Mexico API connections;
- the Walmart Connect and Amazon Ads advertising connections;
- QuickBooks Online;
- connections to third-party logistics providers (ShipBob, ShipStation, Extensiv, Linnworks, Flexport, a generic REST connection and CSV files over SFTP);
- a phone companion over the internet (an encrypted copy of selected figures);
- an online add-on for the AI Assistant;
- automatic updates; and
- until we publish its model, the AI Assistant itself.
B2. No promise. Coming Soon Features are not part of what you pay for. We do not promise that any of them will be released, when, in what form or at what price, or that a third party (for example a marketplace that must approve our connection) will allow it. Please do not buy a License because of a Coming Soon Feature. [not yet available]
B3. When one is switched on. A release that switches on a Coming Soon Feature may come with its own terms and an update to our Privacy Policy, in particular where the feature sends data to us or to a third party; some third parties require their own terms to be passed on to you (for example a disclaimer or a statement that they may end the connection at any time). A feature that sends data off your PC stays off until an Admin turns it on after reading what it sends and to whom.
B4. Third-party approval. Some Coming Soon connections depend on a third party's approval, programme or terms. If the third party refuses, withdraws or changes them, we may keep the feature switched off or switch it off again, with notice where we can give it.
B5. Tests. With your agreement, we may switch a Coming Soon Feature on for your Installation for a limited test (at most 90 days). During such a test the feature is a Beta Feature under section A.
C. The AI Assistant
The AI Assistant is a Coming Soon Feature in the current release: it is not available and is not part of what any Plan pays for. When we publish its model it becomes a Beta Feature included in every Plan. [to be confirmed] Sections C1 to C13 describe it as it will work then.
C1. What it is. The AI Assistant ("Assistant") answers questions about your figures in plain language. It uses an artificial intelligence language model ("AI Model") that runs on your own PC (with Office Server Mode, on the office server PC). It reads Customer Data only through the Software's own reports, one Company File at a time, with the permissions of the Authorized User who asks; only users who may view reports can ask. Fields that hold buyers' and customers' names and contact details, contact persons, users' names, and keys are removed from what the reports give it, and your company's own name is replaced; other text, such as vendor and product names or notes, is not. It cannot change anything in Customer Data.
C2. It is an AI, not a person. The Assistant is an artificial intelligence. The Software labels the panel "AI assistant" for as long as it is open, says it is an AI before a user's first question, and marks each answer as AI-generated; the Assistant must not be presented to anyone as a person. [not yet available]
C3. Turning it on. Nothing happens until an Admin sets it up on the PC that holds the data. The Software checks the PC (it needs at least 16 GB of memory, a 64-bit Windows and a processor with AVX2), the Admin downloads an AI Model of about 2.2 to 2.8 GB from our own download host (Cloudflare R2, under our account) or from Hugging Face, or installs a model file the Software recognises (each file is checked against its known fingerprint), and then turns on "Let users ask the assistant on this PC" after reading a consent screen that names the AI Model, its publisher and its license. Our support cannot accept that consent for you in a Support Session (EULA section 10.3). [not yet released] An Admin can turn the Assistant off, unload the AI Model or remove it at any time.
C4. Your data stays on the PC. Your questions ("Prompts"), the figures the Assistant reads to answer them, and its answers ("Outputs") do not leave the PC that runs the AI Model (on an office network, a question travels from a user's PC to the office server PC and back). We do not receive them. No conversation is stored: a question and its answer are gone when the panel is closed. The AI Model file is kept in the Software's data folder and is not part of your Backups. Neither we nor the AI Model learn from your Prompts or Outputs: we do not use them, or any Customer Data, to train or improve any AI model.
C5. Answers may be wrong. Outputs are generated automatically by a statistical language model. They can be incomplete, out of date, misleading or wrong, even when they sound confident, and the same question can get different answers. The Assistant can misread a question, pick the wrong report or period, or calculate wrongly. The Software marks figures in an answer that it could not find in the reports the Assistant read, but it cannot catch every error. Always check an answer against the Software's reports before you rely on it.
C6. Not advice; no decisions about people. Outputs are not tax, accounting, financial, investment or legal advice, and are not a substitute for a qualified professional. Decisions you make using them are your own responsibility. Do not use the Assistant to make or support decisions that have legal or similarly significant effects on a person (for example about employment, credit, housing, insurance or access to services).
C7. Acceptable use. You and your Authorized Users will not use the Assistant: (a) for anything unlawful, fraudulent or deceptive, or to harass or harm anyone; (b) to create content that infringes anyone's rights, or to present Outputs to others as professional advice or as human-written where that would mislead; (c) to profile, categorise or make automated decisions about people; (d) to try to get around the Software's permissions or limits, to make the Assistant ignore its instructions, or to extract, copy or reconstruct the AI Model or the Software; (e) with Marketplace Data that a marketplace's or other provider's terms do not allow you to use with an AI system; or (f) to generate sexual, hateful or violent content, content that impersonates a real person, malicious code, or personal information about a person that you have no right to use. Our Acceptable Use Policy also applies.
C8. Your Prompts and Outputs. You are responsible for the Prompts you and your users enter and for how you use the Outputs. As between you and us, you own your Prompts and, to the extent the law allows anyone to own them, the Outputs generated for you; we claim no rights in them. Similar Outputs may be generated for other customers who ask similar questions about their own data. You may use Outputs for your business, including sharing them with your advisers, lenders and clients, subject to section C7 (in particular, do not present them as professional advice or as human-written where that would mislead).
C9. The AI Models. The AI Models the Assistant can download are made by third parties and provided under their own open-source licenses, which the consent screen names and links. At the date of these terms they are Qwen3.5 4B (made by the Qwen team; we converted it to the file format the Software uses, without further training) and IBM Granite 4.2 3B, both under the Apache License 2.0. Those licenses govern the AI Model files; their notices are in our Open-Source Notices. We may change which AI Models the Software offers in an Update.
C10. Reporting a problem. If an Output contains something offensive, infringing or harmful, or the Assistant behaves in a way you think is wrong, tell us at [email protected]. We may then change how the Assistant works, change or withdraw an AI Model, or limit or switch off the feature in an Update.
C11. Performance. How fast the Assistant answers depends on your PC. The speed the Software shows before a download is an estimate. The PC answers one question at a time: up to 5 more questions wait their turn, and a question that has waited 5 minutes stops with a message to try again.
C12. The online add-on. An online add-on, with answers from a service we run, is a Coming Soon Feature. If we offer it, it will be off until an Admin turns it on, and its own terms and privacy notice will say which provider receives what, before anything is sent.
C13. No warranty; limitation of liability. THE ASSISTANT IS A BETA FEATURE AND IS PROVIDED "AS IS" (SECTION A3). TO THE EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR LOSS ARISING FROM RELIANCE ON OUTPUTS THAT WERE NOT CHECKED AGAINST THE SOFTWARE'S REPORTS (SECTION C5). EULA SECTION 15, INCLUDING SECTION 15.5, APPLIES TO THE ASSISTANT.
